Suspended African National Congress (ANC) Secretary-General Ace Magashule has allegedly filed papers to challenge his suspension. Magashule allegedly served Luthuli House with court papers challenging the constitutionality of the “step-aside” ANC 2017 Conference resolution and the ANC’s National Executive Committee’s (NEC) decision that resulted in his suspension, SABC reports.

Magashule was suspended from the party for his alleged involvement in cases relating to fraud, corruption and money laundering. The former Free-State Premier was also given until Friday, May 14, to publicly apologise after sending a suspension letter to party president Cyril Ramaphosa. If he fails to do so, he could face further disciplinary action. According to Times Live, Magashule indicated rule 27.5 of the ANC’s constitution in the court papers. The rule states those charged with corruption or criminal charges must step aside from their positions until proven guilty.
Magashule allegedly wants the rule in the ANC’s constitution to be declared unlawful, unconstitutional, invalid, null and void. Meanwhile, he will be represented by Mabuza Attorneys, who recently withdrew as former president Jacob Zuma’s legal representative in his corruption trial.
Meanwhile, a video of Magashule circulated late on Thursday, May 13, where he can be seen imitating Rocky Balboa in a boxing gym, punching a bag.
