Last week, Britney Spears requested to have her father removed from her conservatorship. However, a judge denied the request- again.
Here’s what happened.
New court documents filed by the Los Angeles Superior Court on Wednesday noted that the judge denied a months-old request for Britney to remove her father, Jamie Spears, as her sole conservator, according to Variety.
The documents were filed by Britney Spears’ attorney, Samuel Ingham III, and the Judge who denied them is named Brenda Penny.
“The conservator’s request to suspend James P. Spears immediately upon the appointment of Bessemer Trust Company of California as sole conservator of the estate is denied without prejudice,” said the court documents as per The Gaurdian.
These documents, however, are not Spears bombshell testimony that happened last week. According to Variety, the judge can’t make any rulings based on what she said because she would still need to file a petition to terminate her conservatorship.
However, publications are expressing that the denial of removing Jamie Spears is a setback for the #FreeBritney movement.
Nothing new.
The judge’s denial is not new. Samuel Ingham III had filed the request in November last year and expressed that Britney Spears was “afraid of her father.”
The judge then too declined to suspend Britney’s father from the conservatorship. November 2020 was when Breda appointed Bessemer Trust as a “co-conservator” which has been rubber-stamped in continuation.
So the judge knew about Britney’s turmoil after last week’s testimony when she signed the papers?
Yes. Even though the request was filed months ago, the judge still signed the papers after listening to Britney’s chilling and shocking testimony last week. The decision was made after the fact on June 30.
In Britney’s testimony last week she expressed that she “cried on the phone for an hour and he loved every minute of it,” in reference to her father. “The control he had over someone as powerful as me- he loved the control to hurt his own daughter 100 000%.”
But why the denial?
Allegedly, the court filing states that Britney Spears was found to be “substantially unable to manage his or her financial resources or resist fraud or undue influence,” as per Variety.
So what does the denial mean?
Spears’ father has been her sole conservator since 2019 but has been a co-conservator since 2008. In September 2019, he “temporarily relinquished his powers” and Jodi Montgomery became the conservator of Britney’s person, which means medical and personal well-being matters.
However, her father is now still the sole conservator of her estate and all her finances, which are substantial.
What does her father have to say?
Apparently, he is concerned about the management of his daughter, according to his attorney, and believes that her petition to appoint Montgomery, filed by Ms. Spears’ attorney “does not reflect her wishes.” In a court filing, her father has expressed his concern as per his lawyers, according to The Guardian.
Montgomery denied Jamie Spears’ position, stating that she is a tireless advocate for Britney and for her well-being.”
But what does Britney want?
Britney Spears wants the conservatorship to end altogether.
“I just want my life back. And it’s been 13 years. And it’s enough.”
