There are currently 97 investigations being conducted by the Western Cape Liquor Authority (WCLA) for contravening lockdown regulations related to alcohol between March 27 and July 17. This news has been heartily welcomed by MEC for Community Safety, Albert Fritz.
Of these 97 investigations, 44 matters were placed on the Liquor Licensing Tribunal’s (LLT) case roll of which:
– 34 licences were suspended
– 8 applications were dismissed
– two applications are pending
“I commend the WCLA on their consistent efforts to prevent alcohol-related harms and ensure that there are enough beds in our hospitals for those who need it most during this difficult time. At the same time, I call on residents to report transgressions where they become apparent either to SAPS or the WCLA,” Fritz said.
Of the 34 licences that were suspended, 33 section 71(4) return hearings, as well as further section 20 considerations on 13 of these matters took place, of which:
– One suspension was extended pending a section 20 consideration, while 30 suspensions were lifted by the LLT; and
– Two suspensions were lifted, one in the High Court and one as part of an internal Appeal Tribunal proceeding.
“Of the 30 suspensions that were uplifted, these matters may be returned to the LLT in terms of section 20 for those cases where prima facie evidence exists for any contraventions in terms of the Western Cape Liquor Act,” Fritz added.
