Convicted racist, former estate agent Vicki Momberg, was granted bail of R2 000 on Thursday by the Randburg Magistrate’s Court. This comes after an appeal against her conviction and sentence is still pending.

Momberg was convicted of using racial slurs after a black police officer tried to assist her after she was involved in a hijacking incident.

She also claimed that she was wrongly convicted, saying she suffered from temporary insanity when she used the k-word more than 40 times in video evidence submitted to court.

The state made the decision not to oppose the bail application as they reasoned that she would soon be due for parole.

Momberg made the application for bail in the Randburg Magistrate’s Court after being granted leave to appeal both her conviction, as well as sentence, by the South Gauteng High Court this week.

Prosecutor Yusuf Baba told the court that he had already discussed the matter with Momberg’s lawyer, Kingdom Onah, who had agreed that it was pointless to oppose the bail application as Momberg had already served four months of her two-year sentence.

Baba also pointed out that Momberg had never missed a court appearance, and that she was not a flight risk.

Momberg had filed for leave of appeal by challenging the video evidence presented to the court, claiming that it had been tampered with.

She also argued that the sentence handed down to her was excessive.

The court had handed Momberg a three-year sentence‚ one year of which was suspended on condition that she was not found guilty of a similar crime within the next three years.
